近來律政劇荒,預期未來也只有【The Good Fight】【Billions】可以期待一下。閑慌之際,前川普國家安全顧問,人稱Michael-LockMeUp-Flynn的量刑審判上了一出大戲。

案情背景:

前三星上將轉川普競選顧問轉川普國家安全顧問轉【通俄門】污點證人的Flynn,因積極配合FBI調查有功,檢方只起訴他一個向FBI撒謊的小罪,並向法官請求免牢獄的量刑。

場外Flynn的老友記川普也不忘打Call

似乎這將是一場皆大歡喜,直接了當的愉快判決,Flynn只是來走個過場。甚至還有Foxnews應援團認為,法官會直接把起訴否決,Flynn當場無罪釋放!

這將是多麼美妙的一天!(看到我嘴角的微笑了嗎?)

開庭後的畫風也很正常,就是互相友好慰問。

然而,畫風馬上一轉,法官大人直接開噴:

法官直說了:我也不隱瞞對你罪行的深惡痛絕了。你這算是賣國了,知道嗎?

"I am not hiding my disgust, my disdain for your criminal offense," Sullivan said

你要我今天量刑判決的話,不能保證你不入獄哦。(雖然你跟檢方都簽認罪協議了,但是量刑是我來決定的哦)。

然後法官又問Flynn三次,你要我現在量刑判決嗎? 還要再考慮下嗎?有其他話要說嗎? 你明白我意思嗎?

然而Flynn的律師好像蠻有自信,說:法官大人,來吧。

不對。。

下面中間白頭髮的才是他。

法官見Flynn好像還沒聽懂他的話,轉過頭來問檢方: Flynn是可以在你們另一樁案件中被刑事起訴是嗎?並且可以是重罪起訴是嗎?

法官甚至還問檢方: 你們可不可以起訴Flynn叛國罪

Hypothetically could he have been charged with treason?」 Sullivan asked prosecutor Brandon Van Grack.

Van Grack answered, 「Because It』s such a serious question, I am hesitant from answering.」Sullivan later said: 「I wasn』t suggesting he was committing treason. I was just curious if he could have been charged. Lots of conspiracy theories out there. Not taking any uncalled offenses into consideration. Was trying to consider benefit. I』m not suggesting treason. 」Van Grack said, 「The government has no reason to believe the defendant committed treason.」

法官甚至直白向Flynn表明:你小子的罪行,遠不止一個撒謊罪,這是檢方給你便宜,雖然你們達成協議,但量刑是我的決定,你不跟FBI合作,等到所有的相關的案件都了結,我是沒那麼輕易給你輕判的。

然後,法官還當場懟Flynn的律師,說他在法庭文件質疑Flynn的認罪其實是FBI設置的一個陷害他的陷阱,侵害Flynn的合法權利,騙Flynn撒謊,並指責FBI行為不當。是否還堅持同一說法。 你這一套說辭看起來是要逃避責任啊?

The judge said that looked liked 「backpedaling」 from the guilty plea.

這時候Flynn律師好像醒過來了,慌的一匹,除了否定了他在提交法庭文件中提交的質疑FBI的觀點,還進一步解釋,提交給法庭的觀點是我們自己寫的,跟Flynn認罪是沒有任何關係的,完全沒有逃避責任的意思。基本是跪求饒恕的口吻。

相信他此時的心情是這樣的。

此時此刻,Flynn已經對面牢獄判決沒有任何希望了,接受了法官大人延遲判決,待他與FBI配合的案件有進展後再量刑。

同時,法官要求限制Flynn的出行,明天3月再審。

U.S. District Judge Emmet Sullivan said he has significant outstanding questions about the case, including how the governments Russia investigation was impeded and the material impact of Flynns lies on the special counsels inquiry.

In an order entered on the courts docket after the hearing, Sullivan also imposed travel restrictions on Flynn. Beginning Jan. 4, 2019, Flynn must stay within 50 miles of Washington, D.C., and must seek permission from Sullivan to travel outside that prescribed area. Flynn is also required to surrender his passport by Jan. 4 but Sullivan has approved Flynns previously planned international travel.
